Yes, $600 is an insult. Even more so when you see what other countries have done/are doing for their citizens. But for too many, *principle* is not something we have the luxury to exercise when food, shelter, and health are at risk.

Sterling is here at the Fulton County Elections Division to file an election challenge.

The challenge took place after Sterling got a third-party election flyer at his Sandy Spring home reminding a voter named Meron Fissha to pick up the absentee ballot she requested and be sure to “Return it quickly to ensure your vote is counted.”

There was one problem. Meron Fissha had sold her house to Gabriel Sterling in 2018 and moved to Maryland, according to Sterling’s election challenge.

  12. December 22, 2020 at 1:09 pm

As Congress passed a new $900 billion economic rescue package on Monday night, Senate Majority Leader Mitch McConnell (R-Ky.) offered a choice bit of spin on how we got to this moment:

“A few days ago, with a new president-elect of their own party, everything changed,” Mr. McConnell said on Monday. “Democrats suddenly came around to our position that we should find consensus, make law where we agree, and get urgent help out the door.”

Getting the story right here is highly consequential. It will shape the arguments that determine the outcome of the Georgia runoffs — and control of the Senate — and should leave little doubt that continued GOP control means McConnell will strive to sabotage the recovery to cripple Joe Biden’s presidency.

This is what McConnell wants to obscure. Because as he has privately admitted, the failure of Congress to deliver a robust aid package to people is putting his Georgia senators Kelly Loeffler and David Perdue at risk.

So McConnell wants voters — especially those in Georgia — to believe Republicans supported generous aid all along, particularly the stimulus checks in the new deal, and that Democrats refused to act, to harm President Trump’s reelection campaign.

Maddow: “U.S. mired in ‘3-way split screen’ of Trump crises”
“Rachel Maddow outlines how the United States is caught in the coronavirus pandemic crisis made worse, possibly on purpose, by Donald Trump’s mishandling, as well as an election crisis perpetuated by Trump apparently driven mad by sycophants and the fact of losing, and thirdly, the pressure of looming criminal liability for Trump and some of his hangers-on who could benefit from a presidential pardon.”

“And so Newsmax and OAN appear likely to face the same fate as so many of President Trump’s sycophants, who have watched him lie with impunity and imitated him — only to find that he’s the only one who can really get away with it.”

“Feds have discussed making a legal request for Giuliani’s electronic communications,
say two sources. The federal investigation of the president’s personal lawyer is ongoing, said two sources familiar with the matter, with one saying it is “very active.””

SDNY expressed interest and have discussed with Main Justice about getting electronic communications
    from Rudy Giuliani.

    • December 22, 2020 at 2:45 pm

      Chuck Rosenberg,
fmr senior official in the Justice Department and former U.S. Attorney, speaking to Maddow:
      Maddow:
“In terms of the way Main Justice and the prosecutors would interact here, I should reiterate,
we know that the prosecutors who are investigating Mr. Giuliani at SDNY have expressed interest in getting these communications. We know they have talked to Main Justice about that. We just had an eloquent explanation from Danya (Perry) about the kinds of concerns Main Justice might have about the fact that he is an attorney and you have to protect the sacred nature of attorney-client privilege. But that there are also Justice Department rules governing these things. One of the parts of this box that’s still blocked to me that I would really like to see into, is whether there has been any effort by Main Justice to lean on SDNY about this. Or to improperly intervene, or divert, or slow them down. We don’t know. Where would we look or how would we approach this in order to see whether that was the case?”
      Rosenberg:
“You know it’s interesting to me Rachel, when we’ve seen that heavy handed political interference.
For instance in the Stone and Flynn cases, how did we learn about it? We learned from the line prosecutors in the field about what was happening right? There was this hue and cry from AUSA’s in the field. And so not hearing that, and not hearing that in this case, I’m assuming some regularity here that is just Main Justice career folks and the field SDNY AUSAs in this case, working together to try and get a search warrant approved. So presumption of regularity, Danya explained it really well. And I’ve been on both sides of the equation. I’ve been in the field as an AUSA. I’ve been at Main Justice. There’s a typically healthy tension, occasionally it gets a little unhealthy, but typically a healthy tension between the two. And Danya is exactly right. Main Justice consults at the request of the field on these search warrants for attorneys. They want to make sure that there’s a filter team, a review team in place, because we do take the attorney-client privilege very seriously. They want to make sure that the prosecutors in the field have exhausted other alternatives. Meaning they really, really need this stuff via search warrant. And all those things being in place, being accurate, typically as Danya said the folks at Main Justice sign off on it. I haven’t had trouble as an AUSA in the field getting these types of warrants approved.”

    • December 22, 2020 at 2:47 pm

      Maddow:
“Chuck let me ask you about Mr. Giuliani’s case in the particular,
because he has been involved in so many of these lawsuits, trying to overturn the election results. On one of the filings that they made in the Pennsylvania case, you can see that Mr. Giuliani uses an iCloud
account – iCloud of course is an Apple product. If Mr. Giuliani reacts tonight by putting all of his electronic devices in a blender and hitting purée, would you expect that Mr. Giuliani’s electronic communications could nevertheless be obtained by subpoena or via search warrant through the companies that he has used for either his phone service or his data plans?”
      Rosenberg:
“Well sure that’s a great question Rachel.
There are a bunch of places that investigators will go. For instance they could go to the provider, Verizon or T Mobile, or whoever that may be. And get stuff that is stored. They could go to Mr. Giuliani’s home or office and get his devices and get communications off of that. They can even get communications from other people with whom he has corresponded. I mean unless Mr. Giuliani is only writing to himself, there are other people involved in all of these communications. And so when you take a belt and suspenders approach to investigations, you go to each of these places and you get as much as you can, and you try and corroborate it with other stuff that you get from other people. You know one thing that strikes me Rachel, Mr. Fruman and Mr. Parnas who you talked about earlier, we have no idea whether or not at this point they’re cooperating, and whether or not their cooperation is what led prosecutors in the Southern District of New York to take this next step. Maybe that is part of the probable cause determination. So you triangulate these cases, and you get as much information from as many different places as you possibly can. And so to your point, if he decides to put all his personal devices in a blender and hit purée,
there are still other places for investigators to look.”

Months ago Barr ousted the U.S. Attorney for the SDNY, and tried to replace him with a Trump administration puppet, in an apparent attempt at preventing the SDNY from indicting and arresting Steve Bannon. But the U.S. Attorney refused to resign until he had legal assurances that he’d be replaced by his own longtime deputy, Audrey Strauss. Accordingly, Bannon ended up getting arrested.

Now the courts have determined today that Audrey Strauss, who had been serving as Acting U.S. Attorney all this time, is legitimately the permanent U.S. Attorney. This matters, because her “Acting” tenure was set to expire before Trump left office. But now she’s locked in place until the end of Trump’s term, meaning Trump never will get to mess with the SDNY. In other words, Barr did all that for nothing.

“New Trump rule could cost waiters more than $700 million in lost wages, allowing employers to take more of their tips to pay other workers”

A new rule published by the Department of Labor on Tuesday would allow restaurant owners to take employees’ tips to pay “back-of-the-house” workers, such as cooks and dishwashers.

An analysis by the Economic Policy Institute found that change could cost workers more than $700 million in lost wages.

The regulation also allows employers to required tipped employees to perform more “non-tipped” labor, such as cleaning.

“It’s really, really clear this is about the interests of corporate executives and shareholders,” Heidi Shierholz, an economist at EPI, told Business Insider.
