      thx!
heh i posted after the remarkable Katyal said this last week that he totally let it rip = Ressspect!
–It’s a thing of beauty so please indulge me…and enjoy!
NEAL KATYAL: “OK. So, there`s a lot there.
And with respect to the WHO cutoff, as Ron says, there is both terrible policy judgment here and blatant illegality. On the policy level is I think everyone has been saying, and, Lawrence, you were saying, no,
there is no coronavirus policy by the White House, there are no solutions. We`re in a testing crisis and cutting off funds to an international organization and preening and conferences and, oh, signing some checks to bribe voters, that`s not a coronavirus policy.
And putting your family and no scientist on a counsel to reopen government is not a policy.
And, you know, so I think that this is a real problem from that perspective, and then legally, absolutely, this is no different than what he was impeached for. The president is trying to assert the powers of Congress. In our Constitution, Congress sets the budget and the president can`t just go and nix out items that he disagrees with, and just because he doesn`t like an international organization or some foreign government like Ukraine or some territory like Puerto Rico, you don`t get to like just nix out funding.
That`s not the way our system works.
And, you know, his claims here are very much King George-y. They`re just like what he said a couple days ago when he said, I can force the states to reopen. All of this together is blatantly a destruction of what our
      Constitution is about.
He also said today that he was going to be able to adjourn Congress on his own and put his own judges through and that has three very deep constitutional problems. One is the Constitution just doesn`t let him,. Article Two says he can only adjourn Congress if they disagree.
There is no disagreement there. Both the House and Senate said they should adjourn on January 3rd.
Second, even if he could get over that, it doesn`t allow him to recess-appoint judges, which is what he was seeking to do in the press conference today because the Supreme Court a few years ago in a decision said you can`t use the recess power essentially as an end run around Senate confirmation and that`s, of course, what he`s doing here.
And third, most importantly, if you`re going to try to break constitutional norms and break the Constitution, you better have darn good reason. Here, his reason is, my judges aren`t being confirmed.
Well, give me a break. I mean, he`s had 50 Court of Appeals judges confirmed in three years.
Obama had 55 in his eight years. In the last two years of Obama, he didn`t even get two judge, two court of appeal nominees.confirmed, two. You know, Trump gets that on any given Tuesday.
And, you know, the most galling thing about this is that they have the nerve to say this when they didn`t even get Merrick Garland a hearing. The,president said, oh, the Senate isn`t doing its duty to confirm judges, the Senate by his own party, and that`s why he wants to do this? I mean, boy, we never heard any of that before when he had the most dramatic things at stake.
Sorry, that was a long answer but hopefully gives you something to work with.”

It’s at least 13 now according to the CBC. That is not the final count yet, the RCMP is still investigating, the victims are across parts of the province. Just unimaginable.

Have considerable respect for Mr Katyal, but it is now time for him – in particular – to demand that the DOJ indict and detain Trump.

How will it all matter with a Barr DOJ? Whatever they do, will never move forward. What do you envision if they spoke up?

          Oh my manners! Evening, Bobfr:)

          • April 19, 2020 at 10:03 pm

            Good evening df! 🙂

Lots of DOJ public servants remain true to their Oath of Office and mission.

If Holder, Yates, Comey, Katyal, Bharara and many other former DOJ officials began demanding that Barr either resign or indict Trump, then those current DOJ employees would likely be motivated to challenge Barr to do just that.

Similarly, if those same folk and others demanded that the American Bar Association disbar Barr unless he enforces the law, then it would be unambiguous to every American who is COVID19 positive, as well as, the families of COVID19 victims that they should begin amassing the largest class action law suite in American history.

And, if those same folk publicly committed themselves to doing everything possible to indict and prosecute Trump and every other criminal member of his family and Administration irrespective of how many years or decades it takes, then they would be emulating precisely what survivors of the Holocaust made stick – even to this day.

We don’t need more tweets from these folk, we need the same scale of commitment to pursue these criminals until they are all legally and financially held accountable that President Obama demonstrated by eliminating Bin Laden.

            Just my opinion, of course.

Well, your opinion is valued here:) seems like a no brainer but why is it so hard? Maybe there is something that we just don’t know because I can’t imagine Eric Holder or any others of the people you mentioned being weak or afraid to do the right thing. I just find that hard to believe. What I DO agree with you on is that this criminal needs to be removed before November…. I fear just unimaginable destruction if that doesn’t happen.

Why we have to do it:
Testing, collecting data and finding the hotspots.
Then making sure folks in those hotspots aren’t out spreading the disease, following up with contact tracing and quarantine. That’s how South Korea got a fix on it – after we found out on the same day!
–United States has 123 per million deaths.
–South Korea has 5 per million deaths.

    Checked out BBC podcast yesterday…
Kicked off (factually) saying the U.S. has 700,000 confirmed cases and 31,000 deaths.
THEN (brightly): “Demonstrations are continuing in a number of US states against the coronavirus lockdown…”
    THEN (as if factually):
An audio of a series of aggregious lies Trump told at the press ‘briefing’, where he said he had carried out more tests per capita than all other major countries + took credit for “success” in Texas and Vermont…so that they would start opening for business.
THEN (brightly): BBC reported that Trump said that protestors “seemed to be responsible people” and governors being too tough”.
THEN with no further ado, comment, or kiss my arse: The BBC went straight to news from Spain.
= Outfits (NPR does it too) that present Trump’s lies as is – without factual checking – scare me to death.
