Robert Shrum: Will a Tea Party Supreme Court guarantee Obama a second term? The court’s conservative wing appears ready to engage in some despicable judicial activism on ObamaCare….

Recall the scorn toward health reform dripping from the lips of Injustice Antonin Scalia. Or think of the tight-lipped Clarence Thomas, who could send a mannequin to sit in his place at the court’s oral arguments for all the difference his brooding presence makes… Some observers, and administration officials, hold out hope that Chief Justice John Roberts and Justice Anthony Kennedy will decide to save health reform from the revanchist claims of right-wing constitutionalism. I’m pessimistic because I lived through Bush v. Gore, when the court acted like a political ward committee…

…. Largely missing from the coverage of the health reform case are the most important consequences of nullifying the law: The tragedy of tens of millions who would again be left without insurance… It took a hundred years to remedy all of this by passing health reform; it could take decades to pass it again….

…. The president certainly doesn’t want to see his landmark achievement, unequaled since the New Deal and the civil rights revolution of the 1960s, left in the judicial dust. But ironically, such a result could rebound to his benefit…. So far, Republicans have been able to demagogue health reform without providing any real plan of their own …. Romney and his party would have to say something more, but they have nothing coherent to offer….

…. I hope my pessimism about a right-wing revolution dressed in judicial robes will be proved wrong …I hope that John Roberts, who at President Obama’s swearing-in couldn’t remember the Oath of Office, at least remembers his own….. I hope for this, but I fear the alternative, a decision that would live in infamy….

…. Perhaps the GOP presidential candidates are right about the boilerplate echoing off the walls at their rallies — that this is “the most important election of our lifetime.” And unless they draw back from the brink, a slim Republican majority on a debased Supreme Court will help Obama win it.

    That’s really a dumb column by Bob Shrum. POTUS is odds on favorite to win reelection regardless of the Supreme Court. Saying that POTUS needs the Court to go against ACA to win reelection is just dumb.

        Gotcha. I don’t think there are ever any guarantees on winning any election so I would disagree with Shrum on that too. I’m with Intrade which today says that Pres Obama has a 60% chance of winning in November.

      This is an MSM strategy so in case the ACA is upheld there is still a “bad news for Obama” angle that can be spun. I wonder whether there are any recent articles (after 1PM yesterday) about the Supreme CT and ACA. I’ve been noticing a kind of relative silence from the MSM on this issue since midday yesterday and I don’t think it’s due to the mega millions. PBO also seemed to have a pep in his step at his two fundraisers yesterday, and he continued to highlight the ACA as if it were not under any threat.

      I will be looking closely tomorrow to see what the Sunday Republican Propaganda shows are focusing on.

    Agree with Schrum on the Sup. Ct. decision—-I’m hopeful but am pessimistic about the outcome. I think people who think Roberts will all of a sudden and for the first time ever decide in an objective, non-partisan manner are fooling themselves. As someone noted, whenever he cannot get a unanimous decision, he has always sided with the conservatives. And Kennedy is not as swingy as some have hopefully described either.
    And I agree that this next election is for all the marbles—-it is not hyperbole to state that the future of this country is definitely at stake.

          Good morning derbingle! I have been reading the MSM all week, and on Friday, I didn’t just note what was said, but also what wasn’t said. For example, I watched Tweety bray doom and gloom about the ACA from Mon-Thur only to not mention anything about it on Friday. Instead, he went into some ridiculous monologue about how Romney’s organizational skills and ability to defeat all his opponents in the GOP primary will make him a strong candidate against PBO in Nov. Tweety also tried to downplay PBO’s strong polling numbers by stating that March was waaaaay to early and October is the only time you can really predict anything related to the election. Next Tweety cited the economy that is not very strong as a possible problem for PBO in November.

          Not once did Tweety mention the ACA in all his talk about PBO’s election prospects in November – I would think that issue would be front and center considering just a couple days ago, he and Coward Fineman were calling it a “lose-lose” for Obama because they were so sure that the ACA would be struck down. I’ve also noticed an absence of media punditry, articles or speculation about the Supreme CT. decision at any time after midday yesterday. I’ve also noticed that in his fundraising speeches yesterday, PBO spoke openly and forcefully about the benefits of the law as if there is no threat to it’s existence in the near future.

          So I’m thinking there are two possibilities here:

          1. The court’s decision to UPHOLD the ACA has been leaked to media.
          2. The court’s decision on the ACA is irrelevant to what is actually going to happen with the ACA, and the media has been made aware of that fact.

        Last night Shrum was on the Ed show and said if the supremes overturn ACA that will galvanize Democrats like nothing we have seen before. I agree with him. After Bush v Gore, Citizens united, this would be too much. In Presidential elections, very few people go into a voting booth thinking about SCOTUS, it is just understood that the President nominates judges. If ACA is overturned, that will bring SCOTUS to the forefront. The surpemes will be on everyone’s minds and dems can use that to their advantage to rile up the base. They can put the SCOTUS front and center all the way to election day. It will be a reminder that the gop and rw justices will be happy to take away our rights.

    I keep getting emails from Van Jones wanting money for his Rebuild America website. This one was touting his new book where he tells us the 7 mistakes grassroots progessives and the President made. Makes me want to bite the computer monitor. I always reply although I’m sure no one reads it. I told him one of those mistakes must have been people like him depressing Dem. voter turn out in the 2010 election and that I was putting my money where it could help the US by reelecting PBO and as many Dems as possible.

      I saw him as a mixed bag more than trying to depress the 2010 turnout. Even then his effect was minimal. More than anything imo that’s just a problem Dems have always had. 2006 was an aberration because Bush-Cheney-GOP had run everything into the ground. But historically the Democratic base for way too long just does not show up at midterm elections. Republicans do.

    Up with Chris was really good this morning. They had a comprehensive discussion of ACA. He had doctors, lawyers, legislators and policy wonks who understood the law and even helped craft the law. For 2 hours truth and facts reigned. Prof. Akil Ahmar of Yale Law was particularly wonderful. Now Melissa Harris Perry has a panel of women for her show today and the earth isn’t spewing lava. Imagine that.

      UT…i did not get to see MHPs program….i had to go out….

      but i enjoyed Chris’s program….i esp like the segment in which the doc from Mass talked about having health coaches help folks to manage their health issue….

      i remember years ago being part of a community panel that talked how to improve health outcomes…the idea of follow-up from a health coach was one of the ideas mentioned…..

      i enjoyed the segment of Chris Hayes programs to talk about the internal workings of the ACA…..

    Thinking about Shrum’s article and this week, I’ve also remembered when Elena Kagan was confirmed for the SC, and things that were said about her. She is one who has amazing credentials and is known as a persuasive jurist. I am believing that she will be able to talk sense into at least Arthur Kennedy. She has now been on the court for a year, so has been able to work with these people, and establish some cred. I have confidence in Sotomayor and Ginsberg and Breyer too, but somehow, I think Kagan is the strongest and most persuasive. I’m sure she has spent this year building trust with the others. I know the family leave decision went the wrong way, but I have the feeling she is like the president: she chooses her battles, and she knew this one was coming up.
    I think Shrum got out all his frustrations and angst in the op-ed this morning.

      The op-ed was written yesterday morning – before the Court completed their secret vote. Since then I’ve heard nary a peep from the media on this issue. I’ve only heard articles from certain “liberal” outlets now touting the positives of the ACA. I’m no longer hearing emoprog “we should fight for single payer” memes.

    I have a couple of things going today. One of my staff loss her 3 month old baby grand-daughter and the funeral is today. I hate funerals (who doesn’t, right?) but funerals for babies are the worse. After that I have to put in a few hours of work.

A local anchor is making an editorial comment on Trayvon Martin. It is straightforward concise and poignant. It would be great to share with someone who ‘just doesn’t get it’.         I have son who is 35 now. We had that talk with him, over and over when he was a pre-teen and a teenager. I still worry about him. He’s a fine, smart, hardworking man, who chooses to wear locks. It’s wrong that he should be judged about his hair even when he’s in a suit. But it happens.

    Second, military courts abide by a particularly rigid set of criteria to determine insanity. “A PTSD diagnosis by itself typically is not sufficient to create a defense based on insanity,” says Michael Navarre, a special council for the D.C.-based law firm Steptoe & Johnson and a former Lieutenant Commander in the U.S. Navy Judge Advocate General’s Corps.

    The same appears true of traumatic brain injury (TBI), which Bales is reported to have suffered in 2010 and which has been linked to violent behavior in several studies.

      Trust me, Iran isn’t coming to the table ebcause of Bibi’s blustering, but because of all that PBO has done to create a true global community, including Russia (our #1geopoloitcal enemy) and China, which is putting a lot of pressure on Iran.

      I truly tend to think Iran is not trying to get a nuclear weapon, not would it be the end of the world if they did, but because of our pressure, they will end up opening up their program for the world to see.

        I agree it’s not about Bibi. I keep thinking back to the fear that was ginned up re the weapons of mass distruction in Iraq that never materialized and it makes me skeptical when I hear the same argument against Iran. One just never knows, but I take most of this with a grain of salt.

        Just to be clear, the grain of salt comment was not referencing them returning to talks, but of the WOMD part of it.

        Remarkable sequence of events this week which all got tied together when President Obama announced Friday that we were putting additional sanctions on Iran that will impact their ability to sell oil, and we are able to do so now because oil supplies in the world are high enough for the world to do without Iranian oil.

        This week oil dropped $5.00 a barrel and hit as low as $102. A report came out that showed demand markedly weakening, hence the drop in price. The White House has been pushing charts that show how US production has increased under President Obama while consumption has decreased.

        Cannot but wonder if this was not all a part of a master plan to pump up production in order to be able to pressure Iran. Smart, forward thinking president.

        Yep, he started to believe in his own self importance, that he was bigger than the “cause”, they should call it the “The Rush Limbaugh syndrom”. When Rush first started it was all a farse, he even said on many occasions this was just publicity, his persona was NOT real until he drank his own kool aid and became self-important. That’s why Rush is going to fall and fall BIG!

    I do believe that #SCOTUS will uphold ACA, and I believe Kennedy will vote with the liberal judges. I do also believe there is slight chance that Roberts will vote to uphold as well. I hold ZERO FAITH that Alito, Thomas, and Scalia will. Sometimes I think God needs to call those special people home, just to give them a special hug for everything they have done to help people’s lives better.

    But if not….

      ha! my middle son told me he nearly went to that 7-11 for one of his tickets, but never got there.. he was buying tickets at different stores.. and this time missed that one 🙂 he said the greatest thing about that big pot of mega millions was all the hope it brought to people throughout the week.. everyone dreaming of all they could do w/ that amount of money.

It reflects an effort by President Obama to improve his standing among those Latino voters who feel he has not met his 2008 campaign promise to pursue comprehensive immigration reform.

    I disagree that the Administration is doing this for political purposes.He has said for MANY YEARS, that the immigration laws need to be changed in this country. Guess who doesn’t WANT them fixed? We all know the answer to that. They would rather use fear,intimidation and obstruction.

    Man, I missed a lot yesterday. So Keith Olbermann got fired from Current TV and he’s planning to sue. I see all the KO-bots on the intertubes are already out in full force defending Olbermann from the “diva” label, but none as I see it are mentioning that VP Gore also agreed to fire Olbermann. It’s funny how they are twisting themselves in knots to bow at KO’s knees without disparaging VP Gore who faux-gressives, liberals and us usual Dems really like way better than KO.

      I came to KO late in the 2008 primary season. When he was good he show great but when he was bad, he was over the top Glen Beck style. I stopped watching soon after the election of PBO and when it became known that he didn’t vote. I would catch his show sporadically and when I did, I always regretted that hour that was lost. I just went to DK to see if there are any diaries or even something from Keith himself. Nothing. Now I recall when he did a diary and said he was leaving DK. Can’t remember what the dust up was about but I remember thinking, he can certainly dish it but can’t take a punch. Let me tell you, that diary was full of folks begging him to stay. I am always struck by folks who ANNOUNCE their departure. Such self importance. Get the stepping’ is what I say. Even when he was suspended and eventually canned by MSNBC, there were diaries. As of right now – nothing, nada, crickets. Ha. Perhaps he has finally worn out his welcome.

        Interesting. I checked DK yesterday (or whenever the news broke about KO) for the same reason. There was one diary. I skimmed it and the message was the same thing that’s been said here: He can dish it out but not take it…..that he can’t work with people, etc. It was no way a diary in defense of Keith. I was glad that is what I found. Slowly, slowly………maybe DK is becoming more reasonable.

    Martin Case County’s NAACP Chapter Distances Self from Sharpton

    Seminole County chapter president of the NAACP Turner Clayton spoke out to put distance between his organization and Sharpton’s inflammatory rhetoric.

    Clayton said he believes that the expected 3,000 people who will attend Saturday’s march and rally in Sanford will realize the difference between Sharpton’s message and the NAACP’s mission. “I don’t think they can confuse that,” Clayton said. “It’s just that they will have to make a judgment as to whether they want to follow the mission of the NAACP or follow what the Rev.     In case the NAACP president does not know it. Trayvon’s family ASKED Revs Al and Jackson for help. It is Fox doing the racial divide. I heard on our local radio station even Trayvon’s family attorney was on Fox and let Hannity talk him into admitting it was not racial. We should let Fox and the rabid right wing nut jobs brainwash us into being convinced this killing is not racial; although it has other elements such as the Koch brothers, ALEC, & the NRA in it.

    Dr King was murdered marching for justice and civil rights and was never relented . Neither do Revs Al and Jackson.
