Steve Benen: Michael Moore had an item this afternoon about the looming Troy Davis execution:

“President Obama: Can’t you do like Kennedy & send in federal troops to stop this injustice in Georgia? The buck stops with u.”

… I can appreciate why it might seem as if the buck always stops with a president, but in the Davis case, it’s not Obama’s call.

When presidents during the civil rights era ordered federal troops into the South, they were enforcing federal law. Eisenhower and JFK clearly had the authority to act …. Obama doesn’t have the authority to “send in federal troops” to stop the execution.

….. presidential clemency isn’t an option here ….. he has no legal authority to get involved, officially, with a state execution. When the death penalty is imposed for a state crime like murder, it is a state issue.

    Thanks Steve Benen for this. April Ryan need to read this. Everyone want to lay everything at PBO’s doorstep and feet. He is not a miracle worker and there are limitations on what he can do. I am praying for this family..

Those like Cenk and some of the others who think that PBO can intervene in issues simply because he wants to need to sit down, shut up, and read Article II of the U.S. Constitution. People like these folks should never make fun of the tea partiers’ about their failure to understand what is/isn’t in the Constitution ever again because some of them are in the same category.

    I think it is just a ploy on Michael Moore’s part to get more people angry at the president in order to primary him or vote against him. It’s just too much. I am really getting down. I think I need to take a break from poltics for awhile. It’s too stressful with the day to day up and downs. I need to reserver my energy for when the campaign season really takes off.

    Once again, Michael Moore makes it about himself. There are certain laws that belong to the States only and certain laws that belong to the Federal Government only. This is such a case. President Obama can’t always intercede as much as I’m sure he would like to; especially in this case. Moore needs a middle school civics education and a high school government education because he spews a lot of ignorant nonsense.

    Hopefully y’all here have been turning all this nonsense of the “true progressives” into a positive, and realizing that we don’t want these people on our team. There’s no sense EVER in trying to please them, or courting them and trying to get them involved with whatever we’re doing. Notice how just a couple of days ago Moore was all happy with President Obama because Stanley Ann’s son simply said and did what he always says and does, as if it was some revelation to Moore, and now literally the next day Moore is all negative again with the latest poutrage du jour? And as the article points out, Moore is simply wrong. Will you see him correct himself….not likely.

    “True progressives” are all over the place, at all times. They in-fight at the slightest nuance that might be disagreed upon. I just read one of my old haunts yesterday for the first time in many weeks, and the thread was one of the biggest threads he ever had and it was all people intensely arguing with each other about all things Ralph Nader…current, 2000, and all the way to his 60s activism. It was all worth spending countless energy and hours on for these “true progressives.” What a freakin’ waste of time and energy!

    As our great sage, Al Giordano always says, “we don’t want these people in our foxholes.” I’ve been on the Board of Directors for some small nonprofits, and you see these same people crop up often in that world. All they do is sew discontent, worry, and negativity. They stifle progress and change. They do not improve things that they claim to care about. They make things worse. This can’t be anymore clear over these few years of incredible accomplishment from our incredible President, and their reactions to it.

    So the positive take away from all this is to appreciate it when you find good people who can find compromise on the important overarching goals, and work, yes actually work as a team together with a plan to accomplish those goals. Hopefully we call can recognize these traits in people better now, and we all can be more picky who we decide to partner with when we work on issues on our communities.

    Why the hell are so many people obsessed with PBO in this type of way? My first thought about this case was could the Supreme Court stay the execution, not whether PBO would send in the troops! I think it’s intellectual laziness that refuses to understand how government works combined with a creepy obsession with PBO that infects these PL types.

    The Supreme Court would be Mr. Davis’ last hope since the local judiciary and the governor show no signs of moving. I truly hope they intervene.

    Somehow I doubt Troy Davis is terribly important to Michael Moore other than in the way that he can use him as one more way to attack President Obama. His stupidity here- and his bias – is no different than that of Sarah Palin at this point.

    I’m so sorry for Mr. Davis and his family and for all of the folks who’ve worked so hard to prevent his execution over the years. I honestly believe at this point that they are going forward merely because they are unwilling to admit that they may have made a grave error. Its the saddest thing there is, to execute a person who may be innocent… which is exactly why we should really put a stop to capitol punishment.

      But the good news is that the vote was 195 to 230. Many Republicans broke with leadership and joined democrats to vote against the bill due to the offset for FEMA funds. I believe this is a start of the crumbling of the Republicans because they are starting to balk at the ludicrous tactics. This follows the resignation of Lamar Alexander who cited that he cannot vote against his conscience.

    I live in Atlanta.

    The last execution here was video taped by court order because of the drug they use here to do it. Another person on death row went to court to get it because his lawyers believe what they are using falls under cruel and inhumane treatment because they used it on another man and he convulsed and his body jerked around several times.

    I think is the same drug they use on animals called nembutal.

    Also, Michael Moore has the same knowledge of the Constitution as Sarah Palin and Michele Bachmann, which is DIDDLY SQUAT!

    The only thing President Obama could do is call for a federal investigation into the matter, and he’s not likely to because the media would spin it as big federal government getting into a state level issue… plus there’s no guarantee that the end result will be that Troy Davis lives. What if, after said federal investigation, we’re right back to square one and Troy Davis ends up dying anyways? President Obama would have wasted a lot of taxpayer dollars for no reason. If the odds were better, perhaps President Obama would take that risk, but he’s not one to play games with the lives of others, especially in a case like Troy Davis where the system is rigged against him.

    Perhaps its fate that Troy Davis is put to death so that we can reflect on how inhumane the death penalty is, and how badly our legal system is. Regardless, Michael Moore needs to study the Constitution and actually educate himself as opposed to being a misinformed dumbass.

    This man is a new kind of insane. Why do they constantly attack President Obama?? This is so tiresome and OLD!! It suck the energy out of me to read something said or listen to them sometimes. It is crazy of me to only want to hear good when it comes to Obama. I can’t see how the president puts up with it most of the time. You really have to have tough skin and it is crystal clear to me that President Obama has just maybe the toughest skin there is. I’m a way past proud of him.

    Thursday’s big story: House Oversight and Government Reform Chairman Darrell Issa (R-Calif.) will face off against top Obama administration officials Thursday during a hearing on the White House’s “green jobs” push.

    Expect Issa to blast the administration, pointing to a report by Republican committee staff that says President Obama’s green jobs initiatives are “propaganda.”

    The hearing will offer Republicans their latest opportunity to pummel the administration for approving a $535 million loan guarantee to failed California solar firm Solyndra.

    The hearing will include testimony from Deputy Energy Secretary Daniel Poneman, Labor Secretary Hilda Solis and Bureau of Labor Statistics Commissioner Keith Hall.

    Here’s a taste of what Poneman will tell the committee, via his prepared remarks:

    “We have a choice to make today — we can compete successfully in the global marketplace — creating American jobs and selling American products — or we can resign ourselves to importing more of the technologies of tomorrow from abroad. We are therefore taking measures to successfully compete in these emerging global industries and to diversify our energy portfolio by investing in clean energy.”

    Watch for a counter-offensive from Democrats, who will likely point to reports (like this one in The Hill) that Issa and other Republicans have pressed the Energy Department for loan guarantees for projects in their home states.

    The US Federal Reserve has announced that it will launch a new $400bn programme to help the beleaguered US economy by attempting to exert downward pressure on long-term interest rates and to aid the battered housing sector.

    In a statement released on Wednesday, the central bank said that its programme would tilt its $2.85 trillion balance sheet more heavily towards long-term securities by selling short-term notes and using those funds to buy longer-dated treasuries.

    It will also be reinvesting proceeds from maturing mortgage and agency bonds back into the mortgage market.

    “Recent indicators point to continuing weakness in overall labour market conditions, and the unemployment rate remains elevated,” the Fed said in its statement.

        I was very impressed with Martin Bashir!!! He did an excellent job and even brought on Jonathan Alter who is much closer and has unfettered access to the WH, to knock down Suskind’s gossip rag!!!

        That Peter Orzag has got to be one of the biggest jerks out there!!! But no surprise he now works for Ron Suskind’s former bosses at the right wing Wall Street journal!!!

      Actually Bashir confronted him..and forced him to go on the defensive. If you watched the segment, Martin has seriously undermined his credibility. And Martin did not “agree” with him and bash the president with him.

    The mother of the police officer that Davis was convicted of killing told CNN’s Anderson Cooper that she is “absolutely devastated” that the execution has yet to happen.

    “I’m absolutely devastated because I want it over with. … They’ve been through the courts four times there in Georgia. They’ve been to the Supreme Court three times,” Anneliese MacPhail said in an interview from her home, referring to previous delays. “This delay, again, is very upsetting and I think very unfair to us.”

    “I’d like to close this book,” she said. “We feel (Davis is) guilty. The evidence and everything that we have seen – that I have seen , because I’ve been to all the trials – he is guilty, and I believe in that. And so does the rest of my family.”

    Unbelievable beyond words.

    Miscellaneous–One week. Thank God, but where/how will this all end?????? Suskind on LO–muted TV as soon as I realized. I was on the phone w/my daughter. She is on her way home (Chesapeake, VA) from DC. She attended the 46 Mommas Shave for the Brave event at Union Station. An event to raise money and awareness for childhood cancer. Why #46? 46 kids are diagnosed with childhood cancer every day and 7 die every day!!!!!!!!!!!!!!!!!! Childhood cancer get VERY little funding from ACS and little funding from federal government. Very few people know about childhood cancer and all the statistics. Sadly, only way most people learn is if personally affected. Anyway, MY DAUGHTER HAS COMMITTED TO SHAVING AT THE EVENT NEXT YEAR in memory of Walker. I am SO proud of her. Get ready ’cause I’ll likely be “hitting y’all up” for support. 🙂

They are all going to Capitol Hill tomorrow with their bald heads and some of them have their child who is currently in treatment. A huge impression for sure!!!!!!!!!!!!!!!!

      This is so terrible. I feel for the family of the man who was murdered. They must feel like no one cares about their feelings. However, the issue right now is whether another life should be lost. There is reasonable doubt, IMO. I am curious why after all the appeals no one has taken him off of the death sentence, though. I will have to continue to read more about the many appeals and proceedings he has had.

          Hey meta! Hope you are doing well.

          It seems like after the Oklahoma City bombing, a law was created to make it difficult for someone on death row to get their case re-opened if they want to present evidence that they “could have” presented during the original trial. So, apparently, the evidence of the people who recanted their testimony and those who said someone else confessed to killing McPhail was never brought back in front a trier of fact for consideration in Davis’s case.

          I hate to say this, but it appears many of the witnesses are less than choir men and women. Some of them seem to have criminal records. I wonder if that came out in his original trial? Gosh, the evidence just seems so thin for the death penalty…nothing like the Byrd case.
